TERMS AND CONDITIONS AGREEMENT OF SALE

Please read the following terms and conditions carefully and ensure you fully understand them.


By accessing, browsing, or using this Website, you acknowledge that you have read, understood, and accepted the practices described these terms and conditions.

For the purposes of these terms and conditions, MY LURE SHOP PTY LTD, trading as MY LURE SHOP is the goods and or service provider and is also referred to as "MYLURESHOP", "us" and "we".

Customer is the person or other entity that purchases goods and or services, or seeks goods and or services from MYLURESHOP. Customer may also be referred to as "you" and “your”.

The use of this site is governed by the TERMS AND CONDITIONS AGREEMENT OF SALE set forth below. Your use of this site or purchase from MYLURESHOP indicates your acceptance of these terms and conditions.

Our PRIVACY POLICY describes how we collect and use information related to this site and should be read in conjunction with our TERMS AND CONDITIONS AGREEMENT OF SALE.

MYLURESHOP reserves the right to make changes to this web site and these terms and conditions at any time without any prior notice.


PLACING ORDERS

International Orders - International orders are welcomed on the basis that the customer is solely responsible for and liable to pay any additional duties, levies and or taxes or any other additional charge (including freight) that may be applicable or required for any reason whatsoever in the country, territory or nation to which the goods are being shipped. MYLURESHOP assumes no responsibility for or liability to pay any additional duties, levies and or taxes or any other charge (including freight) as described above. International orders are also subject to additional terms and conditions as described in the shipping section below.

Order confirmation and acceptance - All orders placed are subject to confirmation and acceptance by MYLURESHOP, should any order not be accepted for any reason whatsoever, we will refund all monies paid to us in full.

Pricing - MYLURESHOP may vary prices for received orders in the event of price changes. We will advise you if this is the case. If you do not agree to the price change, we will refund all monies paid to us in full.

Order methods - MYLURESHOP uses this site as our sales channel, so to minimise errors and improve efficiency, all orders should be placed using this site whenever possible. Other forms of ordering are accepted only if this site is malfunctioning or you have difficulty using it. Other ordering methods include submitting your order by email to the sales email listed on our contact page. For some organisations where a purchase order is necessary, we still encourage the orders to be placed on-line with the purchase order emailed to the sales email listed on our contacts page.

Stock Quantities - Quantity in stock does not take into account orders already placed which are yet to be processed. It is possible that an order placed earlier will receive part of or all of the stock quantity displayed as in stock at the time of your order. Every now and then, a small inventory discrepancy can also affect the accuracy of the stock status displayed on our web site. We will contact you in the event that your order is affected and can only be part supplied or not supplied at all. In the event of part supply we will either delay your order until it can be shipped in full or ship your order part supplied with a refund for items not shipped and any adjustment to freight charges. In the event your order cannot be shipped we will refund all monies paid to us in full.

Order cancellation and amendment - Any attempt to cancel or amend an order must be made as soon as possible and should be emailed to the sales email listed on our contacts page. Orders cannot be amended once dispatched for shipment. Cancellations attempted after the order is dispatched for shipment will result in the customer having to return the order as outlined in the returns and refunds section of this policy.

PAYMENT

All payments are to be made in Australian Dollars. We accept payment via credit card (Visa & Master card), PayPal and by direct bank deposit.


TITLE TO GOODS

The title to goods supplied does not pass to the customer from MYLURESHOP until each sale amount is paid in full and the goods are dispatched for shipping.

Goods Dispatched for Shipping - The title to goods supplied does not pass to the customer from MYLURESHOP until the goods supplied are paid for in full and the goods are dispatched for shipping. Goods are dispatched for shipping when we have handed physical possession and control of the goods to our carrier Australia Post.

Order cancellation - Cancellations attempted after the order is dispatched for shipment will result in title passing to the customer as described above. Title to the goods will only pass back from the customer to MYLURESHOP after we have physical possession of the goods returned by the customer and have inspected the goods and approved the cancellation and return of the goods.

Goods shipped in error - MYLURESHOP retains the title to any extra goods shipped with your order that have been dispatched in error. We will be liable for all costs incurred to return the goods to us. You should inform us, via an email sent to the address on our contact page, if you have received any goods in error and should not open the individual packaging of the goods received. In the event we decide the goods must not be returned to us and you agree to accept title to the goods, then we will send a written communication that title has passed to you.


SHIPPING

MYLURESHOP will make every effort to deliver on time depending on the service selected by customers. For peace of mind we only use postal methods where the item can be tracked or identified by a unique registration number. 

Insurance - We recommend insurance on all orders as we no longer own or are responsible for goods once they have been dispatched for shipping.

Carrier – we use Australia Post as our carrier for all deliveries.

International Orders – All International orders are shipped via Australia Post’s International Airmail service and delivery takes approximately 5 to 10 working days from dispatch. Australia Post does not provide insurance for packages going to certain countries, where this is the case we will need to confirm uninsured shipment if you selected insurance as a shipment option.

Domestic Orders – All Domestic orders are shipped via Australia Post’s Express Post or Regular Mail services. Express Post delivery takes approximately 1 to 2 working days from dispatch, while Regular mail takes approximately 3 to 5 working days from dispatch.

Third party address - We do not ship to third party addresses unless that address is known and can be verified by MYLURESHOP.

Post Office Boxes - We only ship to Post Office Boxes where the payment method is via direct debit. We are willing to ship for payment methods where MYLURESHOP is able to verify the identification of the person placing the order and we will request you to provide additonal information to assist us to do so. If we are unable to verify your identity we will provide you with a full refund.

Refused Shipment and Unclaimed Goods - Customers are responsible for paying any freight charges or additional charges whatsoever incurred due to refused shipment and or unclaimed goods. Customers are responsible for ensuring that all orders are capable of being delivered at the address provided at time of placing the order with MYLURESHOP. The customer is responsible for ensuring someone at the delivery address is available and able to sign for and accept the delivery or alternatively that a secure and approved post box is provided at the delivery address.


RETURN AND REFUND

Cancelled Orders - Cancellations attempted after the order is dispatched for shipment will result in the customer having to return the order to MYLURESHOP at full cost to the customer. Cancellations must be returned undamaged and unopened and must be shipped fully insured, if we do not receive the package back we will not provide a refund. We will only provide a refund once the stock returned is inspected and found to be unopened and in the condition as originally shipped. We will only refund the cost of the goods ordered and will not refund any shipping, handling or insurance charges.


Returns for Refund – All returns for refund must be approved by MYLURESHOP prior to the customer shipping goods back. To seek approval to return of goods please email us at the sales email listed on the contacts page. Returns for refund will only be accepted within 7 days of you receiving the goods. Returned goods must be in its original condition and include all the original packaging. Unless we have made an error in shipping incorrect goods to the customer, all shipping and handling cost are not refundable and returns will be at full cost to the customer and must be shipped fully insured. This return for refund policy is applicable for change of mind, and lack of expertise for use of product. Any incorrect, missing or damaged items received must be reported to MYLURESHOP within 24 hours of you receiving the delivery. If item(s) received is not what was ordered please do not open the sealed package in which it was sent. Any attempt to use the incorrect item will be deemed to be acceptance by the customer of the item(s) as a satisfactory substitute for the one that was ordered and no further claim can be raised thereafter.

WARRANTY CLAIM

All goods sold by MYLURESHOP come with a warranty to be free from any defects or faults. This warranty is not transferable.

Goods under warranty cover will be replaced or repaired by the manufacturer. No refund can be provided under any circumstances.

Warranty only covers the item(s) sold by MYLURESHOP.

A large percentage of returned goods are found to be not faulty. If the returned goods are determined by MYLURESHOP to not be faulty, then all returning shipping fees will be worn by the customer. We will seek the permission from the customer to charge this cost to the customer's credit card where possible. Failing this, the goods will be sent back by Australia Post COD freight collected. MYLURESHOP also reserves the right to charge the labour cost for examining these goods where no fault was found.

All warrantees are voided if returned product is found in any way to be mishandled, misinstalled, modified, tampered, abused, physically damaged.

Please attach a copy of the original invoice or provide the original invoice number. A detailed fault description sheet must be sent together with all the returning warranty goods.

Customer is responsible for any shipping and insurance cost involved in sending the warranty claim goods back to MYLURESHOP.

MYLURESHOP is not responsible for any parcel missing in transit, on its return back to MYLURESHOP.

DISCLAIMER

Due to changing market forces and other extenuating circumstances that affect product availability, and price stability we reserve the right to withdraw any product we advertise and change prices without notice.
